This project consisted of the reconstruction of Route 9A in New York City from West 25th Street to West 40th Street for the New York State Department of Transportation. RAI was retained by the General Contractor to review the construction methodology to compute the cost impacts and damages incurred during the duration of the project. A bifurcated trial first required expert testimony from RAI’s principal to allow the Judge to render a decision on the applicability of the “Total Cost Method” for calculating damages. RAI’s report and subsequent expert testimony successfully proved that this method would be applicable in this matter. In the second trial, RAI prepared a Time Impact Analysis, reviewing each of the project’s monthly CPM schedule updates. RAI produced corresponding roadway graphical models that identified the various areas impacted by each of the encountered unforeseen conditions and the number of unanticipated traffic shifts on this highly traveled roadway. Ultimately, the analysis performed by RAI and the expert testimony by the principal of RAI helped support the General Contractor’s entitlement to the bonus paid plus the full cost of the impact damages sustained, as calculated by the Total Cost Method; an unprecedented decision at that time.
